RAD POWER BIKES SERVICE WAIVER AND ASSUMPTION OF RISK
CRITICAL NOTICE: READ CAREFULLY BEFORE SIGNING
BANKRUPTCY AND WARRANTY NOTICE
Rad Power Bikes filed for Chapter 11 bankruptcy protection on December 15, 2024 (Case No. 25-02183, U.S. Bankruptcy Court, Eastern District of Washington). As a result:
- ALL MANUFACTURER WARRANTIES ARE VOID OR UNENFORCEABLE.
- NO MANUFACTURER SUPPORT EXISTS. Rad Power Bikes is not providing parts, technical support, recall information, or dealer assistance during the bankruptcy process.
- REDONDO EBIKES IS NOT AFFILIATED WITH RAD POWER BIKES and cannot guarantee the availability of parts, technical information, or manufacturer support.
CPSC SAFETY WARNING — BATTERY FIRE HAZARD
On November 24, 2024, the U.S. Consumer Product Safety Commission (CPSC) issued a safety warning for certain Rad Power Bikes batteries that pose fire and explosion risks. The warning applies to batteries with model numbers: RP-1304, HL-RP-S1304, RAD-S1304Y (manufactured in China or Vietnam).
The CPSC has documented 31 reported battery fires, 12 incidents with property damage totaling approximately $734,500, and fires occurring when batteries were NOT charging, NOT in use, and in storage.
IMPORTANT: If your bike has one of these batteries, REDONDO EBIKES WILL NOT SERVICE YOUR BIKE UNDER ANY CIRCUMSTANCES. You must immediately stop using the battery and dispose of it according to local hazardous waste procedures.
SCOPE OF SERVICE
PERMITTED SERVICES: Basic mechanical adjustments (brakes, gears, handlebars), tire/tube replacement, chain and drivetrain maintenance, accessory installation, general cleaning and lubrication.
PROHIBITED SERVICES: Battery testing, repair, or replacement; motor diagnostics or repair; controller or electrical system repair; any work on bikes with recalled batteries; warranty claims or warranty-related work.
ASSUMPTION OF RISK AND RELEASE OF LIABILITY
By signing below, I acknowledge, understand, and agree to the following:
KNOWN DEFECTS: I understand that Rad Power Bikes e-bikes may contain design defects, manufacturing defects, and safety hazards including battery fire risks, brake failures, and component failures that have resulted in injuries and death.
NO WARRANTY: I understand that my Rad Power Bikes e-bike has NO manufacturer warranty and that Redondo Ebikes provides NO WARRANTY, express or implied, on any service performed. All service is provided "AS-IS."
ASSUMPTION OF ALL RISK: I voluntarily assume ALL RISKS associated with owning, operating, and servicing a Rad Power Bikes e-bike, including but not limited to: battery fire, explosion, or thermal runaway; brake failure; motor or electrical system failure; component failure leading to loss of control; personal injury, property damage, or death.
RELEASE OF LIABILITY: I hereby RELEASE, WAIVE, DISCHARGE, and HOLD HARMLESS Redondo Ebikes, its owners, employees, contractors, and agents from ANY AND ALL liability, claims, demands, actions, or causes of action arising out of or related to any injury, death, or property damage resulting from my use of the Rad Power Bikes e-bike or any service performed or not performed by Redondo Ebikes.
INDEMNIFICATION: I agree to INDEMNIFY and HOLD HARMLESS Redondo Ebikes from any claims, lawsuits, damages, costs, or expenses (including attorney's fees) arising from my use or ownership of the Rad Power Bikes e-bike or any service provided by Redondo Ebikes.
CPSC COMPLIANCE: I acknowledge that I have been informed of the CPSC safety warning regarding Rad Power Bikes batteries and represent that my bike does NOT contain a recalled battery.
KNOWING AND VOLUNTARY: I have read this entire waiver, understand it completely, and sign it freely and voluntarily. I understand that I am giving up substantial legal rights by signing this document.
This waiver is governed by the laws of the State of California.
